9:00 AM - 10:00 AM Considerations Regarding the Mental Capacity to Give This presentation will discuss various legal and ethical rules relating to the mental capacity to make current and planned charitable gifts. It will provide various measures in the estate planning legal profession for determining such capacity, considerations for development officers when sensing diminished capacity, how to prepare a file for potential challenges by heirs of a donor's mental capacity to give, and how to address challenges that are raised after a donor dies.
Speaker: Kirk A. Hoopingarner, Quarles & Brady LLPKirk Hoopingarner is a partner in the Chicago office of the law firm of Quarles & Brady where he practices in the firm's Trusts and Estates and Tax-Exempt Organizations practice groups. He has been very active in various leadership roles in the Chicago region's philanthropic sector, including having served as Board Chair of McGaw YMCA of Evanston, Board Chair of the Evanston Community Foundation, President of the Corporate Responsibility Group of Greater Chicago, President of the Evanston Township High School Foundation, and as a Director of The Davee Foundation. He is on the editorial board of Planned Giving Today and is a frequent contributor to that on line publication. Kirk is also an adjunct professor in Northwestern University's LLM tax program where is co-teaching a course on tax exempt organizations. Kirk is also a Fellow with the American College of Trust and Estate Counsel, where he is serving on the Charitable Planning and Exempt Organizations Committee.
